ESTANCIA TRANQUILON COVENANTS

 

Carrithers Trust warrants that the maximum number of owner homesteads will be ten.

Owners to stake out their one hectaria homesteads in a square with a maximum of 100 meters per side, i.e. 100 m X 100 m.

New owners must respect a property boundary of at least a 500 meter distance from any existing homesteads, unless consent is given by existing homesteader, to situate it closer.

Owners may build a main house of no more than 2,750 square feet, a guest house of no more than 1,500 square feet, a barn of no more than 2,500 square feet plus two smaller outbuildings – chicken coop, greenhouse, storage shed, etc.

Occupancy will be maxxed out at 6 per owned homestead, and 4 per leased homestead.

No obnoxious noises, smells, or outdoor lights (nothing over 70 watts) are permitted.

Open fires are permitted for cooking etc. If a fire gets out of control and causes damages, the perpetrators shall be held liable for all costs.

Absolutely no motorized off road vehicles permitted. Animal drawn vehicles allowed and encouraged.

 

Each homestead may have two horses grazing on the estancia lands outside of their homestead.

No commercial enterprises are to be conducted on any of the lands unless majority consent is obtained.

Owners shall have access to the adjoining Estancia Colipilli, approximately 27,000 acres, for riding and hiking. They shall also have access to the Andes lands for riding, hiking, camping and fishing – approximately 25,000 acres. There is a private property within the boundaries of approximately 20 acres that is not included with these rights.

Owners may lease an additional homestead lot, of no more than 50 m X 50 m, in a square, and adjacent to the main homestead. Buildings must follow similar square footage as the main homestead.

Owners’ leased homesteads may be cancelled with 90 days notice, and revert back to Carrithers Trust.

Carrithers Trust shall have the right to cancel the 50mX50m land lease, after 90 days of delinquent payments, and utilize the small homestead as they choose.

Owners may sell their ownership shares, only in their entirety, which would include their homestead lease and all improvements.

Upon sale of any homestead, Carrithers Trust will be given the first right of refusal.
